My practice in the past has been that if a player is non-tendered by their real life team, but they still have control years left then the GM can choose to keep the player at their arbitration estimate until new real life contract information is available. This has never been an issue in the past and I've never codified this in the rules. However, lately there have been a number of bigger names non-tendered and it has created an unfair amount of uncertainty for those GMs. With the offseason deadline upcoming some of these are still unresolved.
I'm announcing that a ruling will be issued on this and any teams affected will be allowed to make retroactive offseason rule moves over the next week or so. I'm simply not able to get to anything more than this announcement today, so just know that a clarification is coming, it will be codified into the rules and if you're affected you will be allowed to make retroactive moves.
